ORDER : The Court made the following order :- The petitioner, apprehending arrest at the hands of the respondent police in 1/4
connection with the case in Crime No.263 of 2024 for the offence under Sections 147, 148, 323, 324 and 506 (ii) I.P.C r/w. Section 4 of TNPHW Act, has filed this petition, seeking anticipatory bail.
2. The case of the prosecution is that due to property dispute, the petitioner along with other accused abused the defacto complainant and her father and also assaulted them by using knife and caused grievous injuries.
3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.
4. The learned Additional Public Prosecutor appearing for the respondent strongly opposes for grant of anticipatory bail on the ground that the investigation is pending. He further submits that the injured discharged from the hospital and they are taking treatment in private clinic.
5. The learned counsel for the intervenor submits that if the petitioner is come out on anticipatory bail, he has to murder the defacto complainant and there is no 2/4
safety for her, hence, he strongly opposed for grant of anticipatory bail to the petitioner.
6. Considering the nature of injuries and also considering the gravity of the offence and the previous antecedent of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner, at this stage.
