For Respondent : Mr.Kr.Bharathi Kannan, Government Advocate (Crl.Side) PETITION FOR BAIL Under Sec.439 of Cr.P.C PRAYER :- For Bail in Crime No. 44 of 2020 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner/A5 was arrested on 25.04.2020 for the offence punishable under Section 8(c) r/w 20(b)(ii)(C) of Narcotic Drugs and Psychotropic Substances Act, 1985, in Crime No.44 of 2020 on the file of the respondent Police, seeks bail.

2.The learned Government Advocate (Crl. Side) appearing on behalf of the respondent Police reiterated that the petitioner has involved in two previous cases. As per the confession statement, the petitioner is the main dealer in dealing with Ganja. As far the present case is concerned, 37 kgs of Ganja was seized by the police, which is now under commercial quantity.

3.In view of the fact that the petitioner is dealing with Ganja in large scale manner as a dealer in such in information received by the Police, there is prima facie case to conduct further investigation. The investigation are in progress. https://hcservices.ecourts.gov.in/hcservices/

4.In such circumstances, releasing the petitioner would affect the fair and free investigation of these kind of cases. Then large scale quantity of Ganja involved in this case, the respondent Police shall investigate and find out the involvement of other accused persons, in the manner of such large quantity dealt with.

5. In view of the facts and circumstances, this criminal original petition stands dismissed.
