O R D E R

The petitioner is before this Court seeking a direction to the second respondent to release and hand over the original title deeds pertaining to the property situated at No.54C, Min Nagar, Melagaram, Tenkasi, without insisting on obtaining a No Objection Certificate (NOC) from respondents 3 to 5.

2.The petitioner's deceased husband and the fifth respondent had availed a loan from the second respondent Bank and deposited the original title deeds as security for repayment of the loan. After the demise of her husband, the petitioner, along with the fifth respondent, repaid the entire loan amount. However, the second respondent Bank is refusing to release the original title deeds on the ground that the petitioner must obtain a No Objection Certificate from respondents 3 to 5. 2/4

3.The third and fifth respondents, represented by their respective counsel, have stated that they have no objection to the release of the original title deeds in favour of the petitioner. 4.Notice issued to the fourth respondent has been returned with the endorsement "Left." The fourth respondent has also not made any claim before the second respondent Bank for release of the original title deeds. 5.In view of the above, this writ petition is disposed of with a direction to the second respondent to release the original title deeds to the petitioner within a period of one week from the date of receipt of a copy of this order. It is made clear that such release of the original title deeds shall not prejudice the rights, if any, of the fourth respondent to claim any interest over the subject property.
