Respondents Writ Petition filed under Article 226 of the Constitution of India for the issuance of a Writ of Mandamus directing the third respondents to consider the petitioner's representation dated 30.10.2014 in Na.Ka.No.41/2014-15 in the light of G.O.Ms.No.209(ID) Education Department (A1) dated 08.07.2010 and the order passed in Writ Appeal No.701 of 2015 for sanctioning third incentive increment to the petitioner.

ORDER

The petitioner V.Ramachandran, who was appointed as Secondary Grade Teacher on 15.09.1987 in a Government Middle School at Kanyakumari, was transferred to Government Higher Secondary School at Eluthesapattu in 1988. He was granted first incentive on 05.06.1996, for obtaining B.Ed., Degree, promoted to the post of B.T.Assistant and also transferred to the Government Higher Secondary School at Erumadu, Nilgiri District. Further, he was granted second incentive for obtaining M.Sc., qualification and promoted to the post of P.G.Assistant and transferred to Government Higher Secondary School at Veppanapalli, Krishnagiri District in 2002. Subsequently he completed M.Phil., Degree in 2009 and promoted as Headmaster and transferred to Government High School, Pullagoundanpatti and now he is working as Headmaster.

Therefore, he is eligible for third incentive for obtaining M.Phil., Degree and he has also made a representation to the third respondent on 30.10.2014 for the sanction of third incentive in the light of the order passed by this Court and also as per https://hcservices.ecourts.gov.

G.O.Ms.No.209(ID) Education Department (A1), dated 08.07.2010 and no response is forthcoming, as a result, he is in compulsion to come to this court.

Mr.R.Anandharaj, learned Government Advocate takes notice on the respondents.

Heard both sides and perused the records available. 4.Considering the above submissions, the third respondent, District Educational Officer is directed to consider the representation of the petitioner in the light of G.O.Ms.No.209 (ID) Education Department (A1), dated 08.07.2010 together with the order passed by this Court in W.A.Nos.701 and 769 of 2015 dated 15.07.2015. The petitioner is also permitted to furnish a fresh representation along with the representation already sent on 30.10.2014 within a period of 10 days to the third respondent office in person. On receiving such representation, the third respondent is directed to consider the same within a period of four weeks thereafter.

5. With the above direction, this writ petition is disposed of. No Costs.
