The Civil Miscellaneous Petition has been filed seeking orders to condone the delay of 45 days in filing the appal against the judgment and decree, dated 02.03.2024 in A.S.No.07 of 2023 on the file of the Sub Court, Ramanathapuram, confirming the judgment and decree, dated 07.01.2023 in O.S.No.02 of 2014 on the file of the District Munsif cum Judicial Magistrate Court, Rameswaram, Ramanathapuram District.
2. Heard the learned counsel for the petitioner, learned counsel for the respondents 2 to 4 and also perused the records.
3.The learned counsel for the respondents would submit that they are leaving it to the discretion of the Court.
4.Considering the reasons assigned and also taking note of the quantum of delay, this Court is inclined to condone the delay. Accordingly, this petition is ordered and the Registry is directed to take the appeal on file, if it is otherwise in order and list the matter in the usual course.
