ORDER
This Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the respondent to dispose the petitioner's representation, dated 30.06.2015 with regard to cancellation of patta in survey No.451/36, situated at Sadurpagam, Malwai Village, Lalgudi Taluk, Trichy District on the file of the respondent.
2. Heard the learned counsel for the petitioner. Mr.J.Gunaseelan Muthiah, learned Government Advocate takes notice for the respondents.
3. Originally the petitioner claims to be the original pattadhar in respect of the land. It appears that the petitioner's son, namely Rajarathinam, subsequently obtained patta in the name of his wife. Objecting the transfer of patta, without consent of the original pattadhar, a representation has been given on 30.06.2015 to the Revenue Divisional Officer and the same has not https://hcservices.ecourts.gov.in/hcservices/
been considered so far. Hence, the petitioner has come forward with this Writ Petition.
4. Considering the limited prayer sought for in the Writ Petition, without going into the merits of the matter, since the original patta was issued in the name of S.Rukmani and without her consent, her son cannot transfer the patta in the name of his wife and that the representation submitted by the petitioner is pending for a long time, the respondent is directed to consider the representation of the petitioner, dated 30.06.2015 on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
5. With the above direction, this Writ Petition is disposed of. No costs.
