RESPONDENT/COMPLAINANT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the 5th i.e,(e) condition imposed by this Honourable High Court in granting Interim Bail by its order dt 18.05.2023 in Crl.O.P.(MD0.No.8777/2023 in Cr.No.5/2023 on file of the respondent in the interest justice.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.RAJIV RUFUS V, Advocate for the petitioner and of MR.THANGA ARAVINDH.B, Government Advocate(Crl.side) on behalf of the Respondent, the Court made the following order:- This Criminal Miscellaneous Petition has been filed to modify the condition no.5(e) imposed in Crl.O.P.(MD)No.8777 of 2022, dated 18.05.2023.

2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl.Side) appearing for the respondent.

3.This Court by an order dated 18.05.2023 had granted bail to the petitioner on condition that the defacto complainant is permitted to withdraw the amount deposited by the petitioner. He would further submit that the petitioner was arrested and remanded in judicial custody. She has paid her own money. No amount was deposited in her bank account from the victims. In fact her husband is one of the victims, hence she seeks modification of the said condition.

Taking into consideration the facts and circumstances of the case and also the submission made by the learned counsel for the petitioner, the condition no.6(e) is deleted. 5.Accordingly, the Criminal Miscellaneous Petition is allowed.
