ORDER : The Court Made the following order :- The petitioner/A5, who was arrested and remanded to judicial custody since 19.01.2018 for the offences punishable under Sections 8(c) read with 20(b)(ii)(C), 27(a) and 29(1) of NDPS Act, in crime No.1340 of 2017, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that on reliable information received from the informant, when the respondent police conducted a raid along with his police party, the petitioner and others were intercepted and found in possession of 22 kg of kanja and hence, a case has been registered.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he is no way connected with the crime and he is incarceration from 19.01.2018. He would further contend that the case has been taken cognizance in C.C.No.197 of 2018 by the learned Additional District and Principal Special Court for EC and NDPS Act Cases, Madurai.

4.The learned Additional Public Prosecutor appearing for the respondent submitted that there are 16 previous cases as against the petitioner that too involved in serious offence and there is a bar under Section 37 of NDPS Act..

5.Considering the facts and circumstances of the case and considering the previous cases as against the petitioner, this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this criminal original petition is dismissed. sd/- 09/10/2018 / TRUE COPY / Sub-Assistant Registrar (C.S.)
