ORDER

This petition has been filed to extend the interim bail granted to the petitioner in Crl.M.P.(MD)No.4567 of 2025 in Crl.A.(MD)No.267 of 2022, dated 17.04.2025.

2. When the matter was taken for hearing on 17.04.2025, the learned counsel appearing for the petitioner submitted before this Court that the petitioner has a hole in his heart measuring 26 mm, due to which he is suffering from chest pain. In view 1/4

of that submission, this Court enlarged the petitioner on interim bail by suspending the sentence from 23.04.2025 till 06.06.2025.

3. Today, the learned counsel appearing for the petitioner submitted that the petitioner's cardiac problem is persisting and hence, he requires further treatment. It is prayed to extend the interim bail already granted. It is further submitted that in view of the expiry of the interim bail already granted, the petitioner surrendered on 07.06.2025.

4. Initially, the petitioner was diagnosed to have 'Atrial Septal Defect', for which he had undergone a surgical treatment. After surgery, he has been suffering from chest pain and was advised to undergo Coronary Angiogram. The petitioner has taken Coronary Angiography on 06.06.2025 and the Report states that the petitioner is suffering from 'Double Vessel Disease', for which, he is advised to undergo 'PTCA + Stenting to LAD'.

5. Subsequently, the petitioner has undergone a surgery for 'Atrial Septal Defect'. The Doctor has not stated whether there was recanalization in order to undergo further treatment for the same disease. In the Coronary Angiography, it is reported that the petitioner has got 'Double Vessel Disease'. It is not known whether the petitioner is still suffering from 'Atrial Septal Defect' or not.

6. The Report given by the Assistant Civil Surgeon, Central Prison, Madurai, 2/4

reveals that the petitioner was referred to Madurai Medical College on 02.09.2024 in view of the patch closure undergone by him for 'Atrial Septal Defect' in the year 2022. After investigation, the petitioner was found to be normal and there was no further urgency and no other immediate intervention is required. In fact, on 11.06.2025, the petitioner was observed normal and he was doing all regular works by taking regular cardiac drugs inside the prison itself. The above facts show that the health condition of the petitioner is not serious to allow him to remain out of the prison and continue any special treatment. Hence, I do not find any reason to grant the prayer sought for by the petitioner.

7. If the petitioner develops any symptoms in future, the Doctor in the Prison shall take appropriate steps to refer him to Medical Centre and ensure that he is getting the necessary treatment.

8. With the above observations, this Criminal Miscellaneous Petition is dismissed.
