Prayer: Writ Petition filed under Article 226 of the Constitution of India for the issuance of Writ of Certiorarified Mandamus thereby call for the records of the 3rd respondent in Na.Ka.No. H2/j/g/vz;/32-1/2016 dated 02/06/2016 and quash the same as illegal and arbitrary and further direct the 2nd respondent to take appropriate action against the 4th respondent on the basis of the complaint lodged by the petitioner's husband dated 12.12.2015 in accordance with the relevant provisions of the Sexual Harassment of Women at Work Place (Prevention Prohibition and Redressal) Act 2013.

A charge memo in Na.Ka.No.H2/j/g/vz;/32-1/2016 dated 02.06.2016 has been issued against the petitioner, who is a SubInspector of Police, in respect of her failure in concluding the investigation of three cases relating to Crime Nos.782, 913 and 894 of 2015 in time. Challenging the same, the petitioner has filed this petition. The petitioner also sought a direction to the 2nd respondent to take appropriate action against S.Venkatraman, Deputy Superintendent of Police, Kulachal, Kanyakumari District / 4th respondent herein on the basis of the complaint lodged by the petitioner's husband dated 12.12.2015 in accordance with the relevant provisions of the Sexual Harassment of Women at Work Place (Prevention, Prohibition and Redressal) Act 2013. https://hcservices.ecourts.gov.in/hcservices/

2. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents 1 to 3.

3. The case of the petitioner is that she levelled a complaint against the 4th respondent in respect of his sexual torture on her and insisted upon the 1st respondent to take action against him; instead of taking action against R4, the present charge memo came to be issued against her in order to wreak vengeance and therefore, the petitioner is before this Court with the relief stated supra.

4. When the matter is taken up for hearing, learned Additional Government Pleader appearing for the respondents 1 to 3 has produced the proceedings of the Deputy Commissioner of Police dated 26.08.2016, in which, it is stated that the proceeding as against the petitioner has already been dropped.
