O R D E R
This writ petition is filed seeking a Writ of Mandamus, directing Respondent Nos.1 to 4 to initiate recovery proceedings and take appropriate action against the 5th respondent, who is the Secretary of the 1918 Thazhakudy Primary Agricultural Co-operative Credit Society.
2. Heard the learned Counsel appearing on either side and perused the materials available on record.
3. In response to the notice issued by this Court, the 4th respondent herein filed a counter affidavit stating that all the allegations levelled against the petitioner in the present writ petition were enquired into by the Cooperative Sub-Registrar/Field Officer, Thovazhai, who submitted 2/5
her findings holding that there was no fraud or misappropriation as alleged in the present writ petition. It is further stated that a copy of the said report was furnished to the petitioner herein on 13.01.2021. The relevant portion of the counter affidavit filed by the 4th respondent is extracted hereunder:
''3. I further respectfully submit that the Co-operative Sub Registrar/Field Officer, Thovazhail concluded his report dated 28.12.2020 after having conducted detailed inquiry in respect of allegations mentioned in the petition. The inquiry officer Cooperative Sub Registrar/Field Officer submitted her findings on inquiry that there was no frauds or misappropriation as alleged in the petition which is the base for the present writ petition. The findings of the inquiry officer was properly communicated to the petitioner namely the present writ petitioner. The Writ petitioner received the same on 13.01.2021 by duly acknowledged.''
4. The learned Counsel for the petitioner also fairly submitted that the petitioner received the said enquiry report on 13.01.2021. 3/5
5. In light of the above, the cause in the writ petition does not survive, and accordingly, this writ petition is dismissed as infructuous. No costs.
