Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing 1st respondent to grant approval of the petitioner's selection to the post of Night Watchman in the 2nd respondent Panchayat Union with effect from 28.12.2023 based on the proposal submitted by the 2nd respondent dated 10.01.2024 vide proceeding in Na.Ka.No.A1/3042/2023 within a stipulated time fixed by this Court.

ORDER

This writ petition has been filed seeking a direction to the 1st respondent to grant approval of the petitioner's selection to the post of Night Watchman in the 2nd respondent Panchayat Union with effect from 28.12.2023 based on the proposal submitted by the 2nd respondent dated 10.01.2024 vide proceedings in Na.Ka.No.A1/3042/2023 within a stipulated time fixed by this Court.

2. Heard the learned counsel for the petitioner and the learned Special Government Pleader and the learned Government Advocate appearing on behalf of the respondents 1 and 2. By consent of both parties, the writ petition is taken up for final disposal at the admission stage itself.

3. The petitioner has been appointed as Night Watchman in the second respondent Panchayat Union on 01.03.2022 for daily wages. Pursuant to the communication dated 19.04.2022 to the first respondent to fill up the vacancies to various posts, the second respondent issued notification for the same and the petitioner also applied for the post of Night Watchman and got selected by following due procedures and his selection was also accepted vide resolution dated 28.12.2023. A proposal dated 10.01.2024 was submitted by the second respondent to the first respondent for approval of his appointment. However, the same has not been considered till date. Hence, the petitioner is before this Court.

4. Heard the learned counsel on either side and perused the materials placed before this Court.

Considering the above facts and circumstances of this case, there shall be a direction to the first respondent to consider the proposal submitted by the second respondent dated 10.01.2024 in Na.Ka.No.A1/3042/2023 for approving the appointment of the petitioner as Night Watchman, on its own merits and pass appropriate orders in 3/6

accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

6. With the above observations and directions, the Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
