ORDER
(Order of the Court was made by the Hon'ble N.Sathish Kumar J.) Challenging the order of the learned Single Judge directing the 2nd respondent to consider the 1st respondent's / writ petitioner's representation dated 08.03.2026 on its own merits
and pass appropriate orders in accordance with law after giving opportunity of hearing to the 2nd respondent, the appellant who is the 3rd respondent in the writ petition, has filed this appeal.
2. We are of the view that the learned Single Judge has not decided the lis and no adverse finding whatsoever was recorded against the appellant herein. The learned Single Judge has only directed to consider the representation after providing opportunity of hearing to the 2nd respondent in the writ petition / Superintending Engineer, PWD. However, it is the grievance of the appellant that without giving opportunity of hearing to them, if the abovesaid representation is decided, they would be put into prejudice, since the said representation is pertaining to renewal of registration of the appellant firm.
3. We make it clear that the 2nd respondent herein shall consider the 1st respondent's representation dated 08.03.2026 and pass orders after providing an opportunity of hearing to the appellant herein/3rd respondent in the writ petition. The appellant may produce all the documents to the 2nd respondent in support of their claim and the 2nd respondent shall consider the same and then pass orders.
4 With the above clarification, the Writ Appeal is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
