Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the 1st respondent to cancel the patta bearing patta No.196, obtained by the 3rd respondent in a fraudulent manner from the 2nd respondent for petitioner's property of bearing Survey No.242/7, situated at Vadaseri Village, Kulithalai Taluk, Karur District, and issue separate patta to her.

ORDER

The petitioner herein seeks a direction to the first respondent to to cancel the patta issued in favour of the third respondent in Patta No.196, pertaining to the property situated in Survey No.242/7 at Vadaseri Village, Kulithalai Taluk, Karur District, and issue separate patta to her, by considering the petitioner's application, dated 16.05.2025.

2. Heard Mr.R.Murugappan, learned counsel for the petitioner; and Mr.M.Gangatharan, learned Government Advocate, for the respondents 1 and 2. Since no adverse orders are passed against the third respondent, notice to him is dispensed with. With the consent of both the counsel, the Writ Petition is taken up for final disposal at the stage of admission.

3. It is the case of the petitioner that she purchased 17 cents of land in Survey No.242/7 in two blocks and 32 cents of land in Survey No. 245/5 under a registered sale deed, dated 05.06.1997. According to the petitioner, the third respondent, by producing bogus documents, obtained patta in his name in respect of the property purchased by the petitioner, vide

Patta No.196. Therefore, the petitioner submitted an application before the first respondent on 16.05.2025, seeking cancellation of patta in the name of the third respondent and issuance of patta in her name. The said application has not been considered. Hence, the petitioner has come before this Court.

4. Learned Additional Advocate would submit that patta was issued to the third respondent in respect of Survey No.242/5A and the petitioner has not purchased any property in the said survey number. He further submits, that, in any event, the application submitted by the petitioner will be disposed of on its own merits.

In view of the same, without expressing any opinion on the merits of the claim made by the petitioner, the first respondent is directed to consider the application submitted by the petitioner on 16.05.2025 and pass final orders on its own merits within a period of twelve weeks from the date of receipt of copy of this order, after issuing necessary notice to the petitioner and the third respondent.

6. Writ Petition is disposed of accordingly. No costs. 09.06.2025 NCC :
