Respondents Prayer: Writ petition filed under Article 226 of the Constitution of India, for the issuance of Writ of Mandamus, directing respondents 2 to 4 to provide adequate police protection for the petitioner and her family members for leading a peaceful life in their own house which is in Meyyappanpatti Village and also for protection of life of petitioner and his family members from 5th to 19th respondent based on her representations dated 22.05.2023.

ORDER

This Writ Petition has been filed for the issue of Writ of Mandamus directing respondent Nos.2 to 4 to provide Police protection 2/6

to the petitioner and her family members, since an attempt was made by the private respondents to excommunicate the petitioner and her family.

2. When the matter was taken up for hearing today, the learned Government Advocate (Criminal Side) appearing for the respondent Police produced the closure report. On going through the same, it is seen that an enquiry was conducted by the fourth respondent and in that enquiry, the rival parties / people belonging to the Village have stated that they will not interfere or ex-communicate the petitioner and her family members from the Village. Recording the same, the enquiry was closed.

3. The learned counsel appearing for the petitioner submitted that by compulsion, the signature of the petitioner was obtained.

4. In the considered view of this Court, the rival parties have specifically stated before the Police that they will not interfere or excommunicate the petitioner and her family members from the Village. If in spite of the same, any such attempt is made, it is left open to the fourth respondent to take action in accordance with law. It is made clear that the petitioner cannot take advantage of this order, insofar as some 3/6

criminal cases that are pending against her and those disputes will be independently dealt with in accordance with law. The present Writ Petition confines itself only with the grievance expressed by the petitioner that she and her family members are ex-communicated and that grievance alone is addressed in this Writ Petition.

5. This Writ Petition is disposed of in the above directions. No costs.
