PRAYER :- For bail petition in cr.no.170 of 2019 on the file of the respondent police.

ORDER : The Court Made the following order :- This petition has been filed by the petitioner/ accused no.2 seeking bail for the alleged offence under Sections 457 and 380 of IPC.

2. Heard both sides

3. The learned counsel for the petitioner would submit that a false case has been foisted against the petitioner. He further submitted that the petitioner herein was arrested and remanded to judicial custody on 28.05.2019 and he is in custody for the past 60 days. He further submitted that the stolen properties have been recovered. Therefore he prayed to grant bail to the petitioner.

4. The learned Additional Public Prosecutor would submit that the petitioner herein along with others on 31.08.2018 broke open the door and entered into the house of the defacto complainant and https://hcservices.ecourts.gov.in/hcservices/

stolen gold and silver ornaments. He further submitted that the stolen properties have been recovered. However he opposed the bail on the ground that the petitioner is having four previous cases including two murder cases and investigation is not yet completed. 5.Taking into consideration of the allegations made against the petitioner and also the submissions made by the learned Additional Public Prosecutor that the petitioner is having four previous cases including two murder cases and investigation is not yet completed, this Court is not inclined to grant bail to the petitioner.

6. Hence the bail petition is dismissed.
