PRAYER:

Petition filed under Article 226 of the Constitution of India, praying for the issuance of a writ of Mandamus, to direct the second respondent to measure out the petitioner's land in Survey No.125/4, extent 0.08.5 ares at Nayanan Kollai Hamlet, Kanakkankudi Revenue Village, Karambakudi Taluk, Pudukkottai District and to fix the boundary for the same to help enable the petitioner to put up a fence.

O R D E R

The petitioner claims to be the owner of the land in Survey No.125/4, in Patta No.1482, Kanakkankudi Revenue Village, Karambakudi Taluk, Pudukkottai District. He has constructed a house therein and has been residing with his family, however, he has not put up any fence around his property, while he decided to raise vegetables within his land, he decided to put up fencing, hence, he filed an application before the first respondent to measure his land, for the purpose of fencing his land in the month of January and in the month of February 2016 also. Finding no response, he has submitted a petition to the District Collector, Pudukkottai, on 18.04.2016 on a Public Grievance Day. Although the District Collector by his letter dated 18.05.2016, has directed the first respondent to redress the grievance of the petitioner at an early date, after marking a copy to the second respondent as well as the petitioner, till date, the second respondent has not taken any step to measure the petitioner's land, therefore the petitioner has come to this Court.

2. Mr.S.Kumar, learned Government Advocate takes notice for the respondents.

3. Considering the limited prayer sought for, without going into the merits of the case, the second respondent/ Taluk Deputy Inspector, Survey Department, is directed to measure the property of the petitioner and the said exercise shall be done within a period of eight weeks from the date of receipt of a copy of this order.

4. With the above direction, this Writ Petition is disposed of. No Costs.
