Heard Mr.T.Pon Ramkumar, learned counsel for the petitioner and Mr.M.Siddharthan, learned Additional Government Pleader for the respondents.
2. This Writ Petition has been filed seeking to quash the staff fixation order in Na.Ka.No.2377/A2/2023 dated 10.02.2024 of the third respondent.
3. In the impugned order of staff fixation for the academic year 2023-2024, the petitioner's School has been sanctioned with the strength of 9 teachers, out of which 2 of them are declared as surplus. The total student strength of the petitioner School is 166. 2/5
4. Mr.M.Siddharthan learned Additional Government Pleader for the respondents submitted that the teachers strength had been allowed only in accordance with the Right to Information Act and by considering one teacher against 30 students and hence there cannot be any grievance in the staff strength sanctioned to the petitioner school.
5. The students strength for the classes I to V is 66 students and for whom as per the petitioner School, 3 teachers are eligible. The students strength for the classes VI to VIII is 100, for which 3 more teachers were allotted with 1 Headmaster. So far as the classes 6th to 8th are concerned, the rule would prescribe that the maximum students to be handled by one teacher should not be exceeded by 35.

Since the admission is going on for this academic year by taking into consideration of the total strength of the students and also considering the fact that the next staff fixation would fall on 01.08.2024 for the following academic year 2024-2025, the respondents have to consider the representation of the petitioner School and gives staff strength in accordance with the rules and pass orders. 3/5

In view of the above observations, this Writ Petition is disposed of with a direction to the respondents to consider the representation of the petitioner and gives staff strength in accordance with the rules and pass orders, within a period of four weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petitions are closed.
