RESPONDENT/RESPONDENT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to relax the condition imposed on the petitioner in the petition for suspension of sentence in Crl.M.P.(MD) No.9757 of 2019 dated 17.02.2020, pending disposal of the above said Criminal Appeal.
Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.K.BAALASUNDHARAM, Advocate for the petitioner and of MR.A.SARAVANA KUMAR, Government Advocate(Crl. Side) taking notice on behalf of the Respondent, the Court made the following order:- This petition has been filed to relax the condition imposed by this Court in Crl.M.P.(MD)No.9757 of 2019 in Crl.A.(MD)No.530 of 2019 dated 17.02.2020.
2.On the side of the petitioner, it is stated that this Court has granted suspension of sentence to the petitioner on 17.02.2020, directing the petitioner to appear before the concerned Court daily twice i.e. at 10.30 a.m. and 05.00 p.m. It is stated that the petitioner is complying the condition from 03.03.2020 to 22.03.2020 and subsequently, from 05.10.2020 till date and prayed the condition to be relaxed.

CRL MP(MD) No.6193 of 2020 3.On the side of the respondent, it is fairly admitted that the petitioner is complying the condition as stated by the petitioner and the petitioner was absent from 24.03.2020 to 04.10.2020, due to lock down.
4.Considering the COVID-19 pandemic situation and considering the lockdown period, the failure of the petitioner, to comply the condition from 24.03.2020 to 04.10.2020, is condoned and the condition imposed by this court in Crl.M.P.(MD)No.9757 of 2019 on 17.02.2020, is modified to the effect that the petitioner shall report before the concerned Court at 10.30 a.m. on the first working day of every English Calendar month, pending disposal of the appeal. This petition is allowed accordingly.
