Prayer:Writ Petition filed under Article 226 of the Constitution of India to issue Writ of Mandamus, directing the second respondent herein to consider the petitioner's representation dated 30.09.2020 and take necessary action upon the same within the time limit stipulated by this Court.

ORDER

This Writ Petition has been filed to direct the second respondent to consider the petitioner's representation dated 30.09.2020 and take necessary action upon the same. 2.It is the grievance of the petitioner that the police persons have without wearing uniform trespassed into the house of the petitioner in search of one Duraisamy and abused the petitioner. Hence, she sought to take action against them. 3.The learned Government Advocate appearing for the respondents submitted that the petitioner's son is having 7 cases registered for the offences punishable under Sections 380 and 457 of IPC and apart from that the petitioner is also giving shelter to the said Duraisamy, who is having 56 cases, including 3 murder cases. Only in the context of searching that person, the police personnel went to the house of the petitioner. Therefore, this petition is nothing but abuse of process of law.

4.Merely because the police searched the criminal on suspecting that the petitioner is giving shelter, it cannot be said https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.15838 of 2020 that all such actions are always abuse of process of law. Therefore, I do not find any materials to substantiate the allegations of the petitioner. Accordingly, this Writ Petition stands dismissed. No costs.
