PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents to grant appropriate permission and adequate police protection to celebrate the Vinayagar Chathurthi Festival in the petitioner's temple namely Sri Vallaba Vinayagar Thiru Kovil situates in Senthattiyapuram Pudhoor Village Sivagiri Taluk, Tirunelveli District from 11.09.2018 to 13.09.2018 by conducting Special Poojas, Innisai Katcheri Program, Annathanam and Vinayagar Procession by using sound service based on the petitioner's representation dated 27.08.2018 within the time limit that may stipulated by this Court. This petition has been filed for a direction to the respondents to grant appropriate permission and adequate police protection to celebrate the Vinayagar Chathurthi Festival in the petitioner's temple namely Sri Vallaba Vinayagar Thiru Kovil situated in Senthattiyapuram Pudhoor Village Sivagiri Taluk, Tirunelveli District from 11.09.2018 to 13.09.2018 by conducting Special Poojas, Innisai Katcheri Program, Annathanam and Vinayagar Procession by using sound service based on the petitioner's representation dated 27.08.2018.
2.The learned counsel appearing for the petitioner would submit that the festival is being conducted during the month of Aavani every year and this year, it has been decided to conduct the said festival from 11.09.2018 to 13.09.2018 at Sri Vallaba Vinayagar Thiru Kovil situated in Senthattiyapuram Pudhoor Village Sivagiri Taluk, Tirunelveli District. The petitioner had given a representation dated 27.08.2018 to the respondents seeking for permission and the same has not been considered till date. 3.The learned Government Advocate would submit that the petitioner will have to abide by the conditions that are imposed by the respondent police, while conducting the festival. 4.Taking into consideration of the facts and circumstances of the case, this Court is inclined to direct the second respondent to grant permission and adequate police protection to celebrate the Vinayagar Chathurthi Festival, from 11.09.2018 to 13.09.2018 at Sri Vallaba Vinayagar Thiru Kovil situated in Senthattiyapuram Pudhoor Village Sivagiri Taluk, Tirunelveli District. 5.It is made clear that the respondent police is at liberty to impose any conditions to ensure the peaceful conduct of the festival and the petitioner is bound to comply with the same. 6.Accordingly, the writ petition is disposed of with the above directions. No costs.
