ORDER
This Criminal Revision Petition is filed to call for the records relating to set aside the order passed in Cr.M.P.No.849 of 2025 on the 1/5
file of the Learned Judicial Magistrate, Periyakulam, Theni District, dated 29.04.2025 in Crime No.40 of 2025 on the file of the Respondent Police.
2. When the matter was taken up for admission, the learned Additional Public Prosecutor Mr.S.Ravi submitted that it is a case where the petitioner is the owner of the vehicle involved as well as who is implicated as A-10 in crime No.40 of 2025 on the file of the Jayamangalam Police Station.
3. That apart, he categorically submitted that the vehicle involved had been used by the accused for the purpose of transporting explosives to the private Patta land wherein the said explosives were utilized for blasting rocks without getting appropriate permission from the concerned authorities.
4. Considering the nature of the offence, the Village Administrative Officer had lodged a complaint against the offenders before the Jayamangalam Police Station, as a result of which, crime No. 40 of 2025 came to be registered taking into account that the serious 2/5
nature of the offense involved. The respondent police has already initiated the confiscation proceedings before the learned Sessions Judge's Court, Periyakulam, in Crl.M.P.No.972 of 2025, and it was directed to be posted on 19.06.2025.
5. Under such circumstances, the question of admitting this return of property in this Criminal Revision case will not arise. Recording the submission of the learned Additional Public Prosecutor, this Criminal Revision Petition is dismissed. However, the petitioner is given the liberty to contest the case before the learned Sessions Judge's Court at Periyakulam. No costs.
