ORDER : The Court made the following order :- The petitioner/accused, who was arrested and remanded to judicial custody on 10.06.2024 for the offences punishable under Sections 147, 148, 452, 294(b), 323, 324, 307, and 506(ii) of IPC and Section 4 of TNPHW Act in Crime No.104 of 2024 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that due to previous enmity, the petitioner and other accused abused the defacto complainant by using filthy language and attacked 1/3

him with knife and aruval and also criminally intimidated him. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this case. He would further submit that to wreck vengeance, the defacto complainant given a false complaint against the petitioners. He would further submit the petitioner is in custody from 10.06.2024. Hence, he prayed to grant bail to the petitioner. 4.The learned Additional Public Prosecutor appearing for the respondent police strongly opposed this petition and would submit that the defacto complainant is still in hospital and the investigation is pending.

5. Considering nature of offence and also considering the fact that the injured is still in-patient, this Court is not inclined to grant bail to the petitioner.
