O R D E R
This writ petition has been filed challenging the impugned letter dated 29.07.2021 issued by the first respondent, rejecting the petitioner's request to include the services rendered by the petitioners in the post of Higher Secondary 2/6
School Headmaster for the purpose of calculating the Selection Grade of Pay in the post of District Educational Officer.
2. The request of the petitioner has been rejected under the impugned order on the ground that the Rules does not provide for the request of the petitioner to be accepted. Admittedly, as on date, there are no statutory rules which protects the claim made by the petitioner through her representation, which has been rejected under the impugned order dated 29.07.2021. While that be so, the question of granting any relief to the petitioner in this writ petition does not arise.
3. The learned counsel appearing for the petitioners would submit that the petitioners are willing to give a fresh representation to the first respondent, requesting the first respondent to constitute a One Man Commission to look into the discrepancies with regard to the non-inclusion of the services rendered by the petitioners in the post of Higher Secondary School Headmaster for the purpose of calculating the Selection Grade of Pay in the post of District Educational Officer within a time frame to be fixed by this Court and a direction may be issued to the first respondent to consider the same on merits and in accordance with law within a time frame to be fixed by this Court. 3/6
4. No prejudice would be caused to the respondents if such a direction is issued to the respondents without interfering with the impugned order dated 29.07.2021.
5. Accordingly, this Court permits the petitioners to submit a fresh representation to the first respondent seeking to include their services rendered in the post of Higher Secondary School Headmaster for the purpose of calculating Selection Grade of Pay in the post of District Educational Officer within a period of two weeks from the date of receipt of a copy of this order. On receipt of the said representation from the petitioners, the first respondent is directed to pass final orders on merits and in accordance with law as expeditiously as possible. No costs. Consequently, the connected miscellaneous petition is closed.
