The present Civil Miscellaneous Petitions have been filed to condone the delay of 1319 days in filing petition, to set aside the abatement of Civil Miscellaneous Appeal as against the deceased sole appellant and to bring on record the petitioners 1 to 3 as the legal heirs of deceased sole appellant in the main Civil Miscellaneous Appeal.
2. There is no representation on the side of the respondents and they have not filed any counter.
3. Considering the reasons stated in the affidavit that the petitioner's husband, who filed an appeal died and after his demise, she came to know the communication only in the month of December 2019 and thereafter, due to Covid-19 she unable to file an application immediately and considering the facts and circumstances of these cases, these Civil Miscellaneous Petitions stand allowed, accordingly. 1/3
4. Registry is directed to carry out the necessary amendments in the cause-title.
5. Post the main case on 23.01.2024 under the caption 'For Arguments'.
