Writ Petitions filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the 1st respondent of regularize the petitioners service on basis of Hon'ble Justice V.Khalid's (Former Justice of Hon'ble Supreme Court of India) guidelines for regularization of appointment of workers by the selection committee of TANGEDCO as per the representation dated on 20.01.2022 made by the 1/5

O R D E R

The writ petition has been filed seeking for a mandamus to the first respondent to regularize the service of the petitioner on the basis of the Hon'ble Justice V.Khalid's Commission (Former Justice of Hon'ble Supreme Court of India) guidelines for regularization of appointment of workers by the selection committee of TANGEDCO as per the representation dated on 20.01.2022 made by the petitioner.

2. Heard the learned counsel for the petitioner and the learned Standing Counsel appearing for the respondents.

3. The learned counsel for the petitioner submitted that since the petitioner is aged about 56 years, it would suffice if the representation of the petitioner dated 20.01.2022 is considered and disposed of within a time frame.

4. The learned Standing Counsel appearing for the 2/5

respondents TANGEDCO submitted that if a fresh representation is submitted by the petitioner, the same will be considered and disposed by the Committee formed by the Board Proceedings No.9, within a time frame as directed by this Court.

Considering the limited scope of the prayer now sought for by the petitioner, without going into the merits of the claim made by the petitioner, the petitioner is directed to submit a fresh representation along with a copy of this order and all other relevant documents pertaining to the regularization of appointment to the first respondent within a period of 15 days from the date of receipt of a copy of this order and the first respondent is directed to forward the representation of the petitioner to the Committee. Thereafter, the Committee shall examine the same and pass appropriate orders on merits and in accordance with law by following the guidelines of the Hon'ble Justice V.Khalid Commission Report, within a period of eight weeks from the date of receipt of such representation. No costs.
