Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the respondents to issue an order for the sub divisional patta transfer on considering the petitioner's application made in 2025/0105/30/466758, dated 02.05.2025. ORDER
The petitioner herein seeks a direction to the respondents to issue an order for sub divisional patta for the property acquired by him under a settlement deed, dated 25.10.2023, by considering his application No. 2025/0105/30/466758, dated 02.05.2025.
2. Heard Mr.K.P.Krishna Doss, learned counsel for the petitioner; and Mrs.S.Jeya Priya, learned Government Advocate, for the respondents. With the consent of both the counsel, the Writ Petition is taken up for final disposal at the stage of admission.
3. It is the case of the petitioner that the property to an extent of 303.195 sq.mts. was settled by the petitioner's mother in favour of the petitioner by a registered settlement deed, dated 25.10.2023. Thereafter, the petitioner submitted an application on 02.05.2025 before the respondents, seeking sub division of the property settled in his favour. The said application has not been considered. Hence, the petitioner has come before this Court.
4. Learned Government Advocate would submit that the application submitted by the petitioner will be considered by the respondents on its own merits, within a period stipulated by this Court.
5. In view of the same, without expressing any opinion on the merits of the claim made by the petitioner, the respondents are directed to consider the application of the petitioner, dated 02.05.2025, and pass final orders on its own merits within a period of eight weeks from the date of receipt of copy of this order, after issuing notice to the petitioner and other interested parties.
6. Writ Petition is disposed of accordingly. No costs. 09.06.2025 NCC :
