Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, to direct the respondents to pay the petitioner a sum of Rs.10,19,058/- towards Gratuity, Rs.53,618/- towards Encashment of Leave salary, Rs.7,46,660/- towards Pension Commutation and all other benefits like Social Security fund, Medical college fund, Engineering College fund and Polytechnic fund with 18% interest per annum for the delayed payment from 01.06.2019 to till date, within a time stipulation as fixed by this Court and without affecting the petitioner right to claim the balance amounts towards those benefits.

ORDER

By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself. 2.In view of the non-settlement of the retirement benefits after the petitioner had retired from his service with effect from 31.05.2019 onwards, the present writ petition has been filed, seeking for a direction to the respondents to settle the retirement monetary benefits together with interest at the rate of 18% per annum.

3.Today, when the matter was called, the learned Standing Counsel appearing for the Corporation would fairly submit that the https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P(MD)No.15907 of 2020 respondents are willing to settle the terminal benefits of the petitioner in twelve equal monthly installments. 4.The learned counsel for the petitioner would submit that in view of similar stands taken by the Corporation in other cases, the petitioner is willing to receive the retirement benefits in twelve equal installments along with interest. 5.Recording the submissions of the learned counsel for the petitioner as well as the learned Standing Counsel appearing for the respondent, there shall be a direction to the respondent to disburse all the monetary retirement benefits to the petitioner in twelve (12) equated monthly installments. The first of such installment shall be paid atleast on or before 15.12.2020 and thereafter, the remaining Eleven (11) equated monthly installments shall be paid on the fifteenth day of every consecutive months. 6.With the above directions, this Writ Petition stands disposed of. No costs.
