: Respondents PRAYER : Petition is filed under Section 482 of Criminal Procedure Code praying to direct the first respondent herein to transfer the investigation in Crime No.135 of 2017 from the file of the second respondent to any other investigating officer for free and fair investigation in the light of petitioner's representation dated 18.06.2019.

ORDER

This petition has been filed to transfer the investigation of the case in Crime No.135 of 2017 pending on the file of the second respondent to some other agency.

2. The grievance of the petitioner is that based on the complaint given by the petitioner a case in Crime No.135 of 2017 for the offence under Sections 341, 387 and 506(2) IPC has been regsitered. Even though a case was registered on 29.03.2017, so far the investigation is not completed and final report has not been filed. Hence, the petitioner is before this Court with the present petition.

3. The learned Government Advocate (Crl.Side) appearing for the respondents, on instructions, would submit that already

enquiry on the complaint lodged by the petitioner is over and final report will be filed within a period of one week.

4. Considering the above facts and circumstances and also considering the submission made by the learned Government Advocate (Crl.Side) that already enquiry is over and final report is also going to be filed, at this stage, the prayer sought for by the petitioner cannot be granted. Accordingly, this Criminal Original Petition is dismissed.
