Side) in all OPs ***** COMMON ORDER The petitioners are accused nos.1, 10 & 8 respectively in Crime No.219 of 2024 on the file of the respondent Police. They have moved these applications seeking bail that they are in jail more than a year.
2.There is no representation for the first accused. 3.The accused nos.10 & 8 claim that even according to the prosecution, they were found in possession of 8.5 kg and 8 kg, respectively, of Ganja. Moreover, they have been impleaded based on the confession statement of the second accused. Therefore, they prayed for grant of bail.
4.Learned Government Advocate submitted that 22.600 kgs of Ganja was recovered from the accused nos.1 to 6 on 15.07.2024, in a Mahindra XUV Car. Based on their confession statement, they have proceeded further and arrested the accused 2/5
nos.8 & 9 / the agents, who procured the Ganja from Andhra Pradesh from the tenth accused, who planted, cultivated and supplied the Ganja. According to him, the investigation has been completed and final report has also been filed. 5.He further submitted that this Court has already rejected the bail applications filed by the accused in Crl.OP(MD)Nos.22065, 21981, 22781 of 2024, 425, 1500 of 2025, dated 03.02.2025, with a direction to the trial Court to conclude the trial within a period of six months.
6.The petitioners allege that the trial has not commenced, as directed by the trial Court. However, learned Government Advocate responded that the trial has commenced and PW1 was examined. The case is posted for the examination of PW2 on 11.09.2025.
7.Considering the nature of offence, the quantity of contraband involved and the earlier order passed by this Court, this Court is not inclined to entertain these applications and grant bail to the petitioners. 3/5
8.No doubt, the trial Court is expected to concentrate for the cases in the chronological order. However, priority has to be given to the trials, where the accused are in jail. Therefore, this Court expects the trial Court to conclude the proceedings as expeditiously as possible, as per the earlier direction in Crl.OP(MD) Nos.22065, 21981, 22781 of 2024, 425, 1500 of 2025, dated 03.02.2025. The respondent Police is directed to produce all the witnesses without delay. The petitioners are also expected to cross examine the witness on the same day and to cooperate with the trial Court to conclude the proceedings.
