ORDER
The petitioner herein seeks a direction to the respondents 1 and 2 to grant patta for the land situated in Old Survey No.255/9, New Survey No.542/24, 8th Ward, Saptur Village, Peraiyur Taluk, Madurai District, by considering his representation dated 25.09.2024. 2.Heard the arguments of M/s.S.Jainab Beevi, for Mr.P.Bhaskar, learned counsel appearing for the petitioners and Mrs.K.Malathi, learned Additional Government Pleader appearing for the respondents 1 and 2. By consent of both sides, this Writ Petition is taken up for final disposal
at the admission stage itself.
3.According to the petitioner, his father, Nagiah Servai Purchased 2 1⁄2 cents of land in Old Survey No.255/9, under a registered sale deed dated 18.05.1979. From the date of purchase, the petitioner's father and his family members have been in possession and enjoyment of the said property. The father of the petitioner died in the year 1988. Thereafter, the petitioner has been in continuos possession and enjoyment of the property. During UDR updation, no patta has been issued to the petitioner's father as he failed to make a proper representation to the official concerned seeking issuance of patta. Therefore, the name of the petitioner's father has not been updated in the UDR records. Hence, the petitioner submitted a representation on 25.09.2024 before the second respondent seeking issuance of patta in his name. The said representation has not been considered till date. Hence, the petitioner has come before this Court.
4.The learned Additional Government Pleader appearing for the respondents 1 to 4 would submit that the property claimed by the
petitioner has been classified as 'Natham Vacant Site' in the village revenue records and the same is used as a pathway by the general public. It is also stated that the seventh respondent has raised an objection with regard to the petitioner's claim over the subject property. 5.In view of the said submissions made by the learned Additional Government Pleader appearing for the respondents 1 to 4, this Court, without expressing any opinion on the merits of the claim made by the petitioner, is inclined to direct the second respondent to consider the representation submitted by the petitioner dated 25.09.2024 and pass final orders on its own merits, within a period of twelve weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner, private respondents 5 to 7 and other interested parties..
