ORDER
The petitioner herein seeks a direction to the respondents to dispose of the representation of the petitioner pending in File No. Na.Ka.Pi4/2004/2025 and to rectify the error that had crept in during the UDR updation in respect of the property situated in Survey No.130/3D, with an extent of 60 cents, in Alavidanthan Village Ilayankudi Taluk,
Sivagangai District, in the light of the recommendation submitted by the third respondent in his proceeding in Na.Ka.No.A7/1688/2024, dated 16.10.2024.
2.Heard the arguments of Mr.M.Divakran, learned counsel appearing for the petitioner and Mrs.M.Malathi, learned Additional Government Pleader appearing for the respondents. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
3.According to the petitioner, her husband purchased 60 cents of land out of a total extent of 2 Acre 40 cents in Survey No.130/3D in the year 1984 under a registered sale deed dated 25.02.1984. The land purchased by the petitioner's husband is situated in Subdivision No. 130/3D. However, during the UDR updation, the name of one Pooranam was wrongly included in respect of the said property instead of the petitioner's husband's name. Likewise, the name of the petitioner's husband has been wrongly included in respect of Pooranam's property situated in Survey No.130/3C. Therefore, the petitioner submitted a
representation on 20.05.2024 before the third respondent, seeking rectification of the error in the UDR records. After considering the representation of the petitioner, the third respondent submitted a recommendation before the second respondent in his proceeding in Na.Ka.A7/1688/2024 dated 16.10.2024 for correction of the error. Even thereafter, the second respondent has not considered the request of the petitioner. Hence, he has come before this Court. 4.The learned Additional Government Pleader appearing for the respondents would submit that the second respondent will complete the enquiry and pass final orders in the pending proceedings within the time stipulated by this Court.
5.In view of the said submissions made by the learned Additional Government Pleader appearing for the respondents, without expressing any opinion on the merits of the claim made by the petitioner, the second respondent is directed to complete the enquiry relating to the proceedings in Na.Ka.Pi4/2004/2025 and pass final orders on its own merits, after giving due opportunity to the petitioner and the above said Pooranam,
within a period of twelve weeks from the date of receipt of a copy of this order. Accordingly, this Writ Petition is disposed of. No costs. 10.06.2025 NCC : Yes/No Index : Yes/No Internet : Yes/No cp To 1.The District Collector, Sivagangai District.
