M.Pandeeswari, v. The Commissioner
BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED: 03.01.2018
CORAM
THE HONOURABLE MR.JUSTICE G.R.SWAMINATHAN W.P.(MD) No.24150 of 2017 M.Pandeeswari ... Petitioner Vs.
1. The Commissioner, Madurai Corporation, Anna Maligai, Madurai-625 002.
2. S.Alagupandi
3. S.Paul Pandi ... Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the first respondent to provide a job to the petitioner by cancelling the second respondent's job on ground of compassionate appointment by considering the petitioner's representation dated 06.09.2017. For Petitioner : Mr.A.Jeyaram For Respondent : Mr.G.Prabhu Ramachandran Standing Counsel for R1 : No Appearance for R2 and R3
ORDER
Heard the learned counsel on either side.
2.The petitioner's father was working as a Sweeper in Madurai Corporation. He died on 19.10.1996. The Corporation granted compassionate appointment to the second respondent herein. The second respondent is none other than the brother of the petitioner. The third respondent is another brother. It appears that the second respondent had given an assurance to the petitioner that he would take care of her.
3.The grievance of the petitioner is that the second respondent had not acted as per his undertaking. These are purely family disputes. The Corporation has been unnecessarily dragged into the matter. The second respondent was appointed only after getting no objection from the third respondent. The question of getting no https://hcservices.ecourts.gov.in/hcservices/
objection from the petitioner did not arise, since she was a minor at that point of time. There is absolutely no merit in this writ petition.
4.This Writ Petition stands dismissed. No costs. Sd/- Assistant Registrar (RTI) /True Copy/ Sub Assistant Registrar To The Commissioner, Madurai Corporation, Anna Maligai, Madurai-625 002.
