This Criminal Appeal filed under Section 14A(2) of SC/ST(PoA) Amendment Act, 2015, to call for the records relating to the impugned order passed in Crl.M.P.No.93 of 2025, dated 03.06.2025, on the file of the Learned III Additional District Judge (SC/ST cases), Madurai and set aside the same as illegal and arbitrary and enlarge the appellants/accused Nos.2,4 ,5 and 7 in Crime No.222 of 2025 on the file of the second respondent on bail by allowing the appeal. Prayer: This Petition is filed under Section 528 of BNSS praying to relax the condition which was imposed by this Court in Crl.A(MD).No.637 of 2025 dated 09.06.2025.
ORDER
This petition is filed to relax the condition which was imposed on the petitioners in Crl.A.(MD)No.637 of 2025, dated 09.06.2025 by this Court.
2. When the matter was taken up for hearing, the learned Government Advocate (Crl.side) appearing for the State, on instructions, would submit that the petitioners have been complying the condition regularly, without any default.
3. Considering the fact that the petitioners are complying the condition regularly and also taking into consideration of the reasons cited by the petitioners in the affidavit filed in support of this petition, I feel that the condition imposed on the petitioners can be modified to a certain extent. 2/4
4. Accordingly, the condition already imposed is modified and the petitioners shall appear and sign before the respondent-police, twice in a month i.e., on 1st and 15th day of every English calendar month, till the disposal of the appeal.
