ORDER : The Court made the following order :- The petitioner/A2, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c), 20(b)(ii)(A) of NDPS Act r/w. Section 77 of JJ Act in Crime No.654 of 2024 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 07.12.2024, based on secret information, the respondent police went to the place of occurrence and found that the 1st accused was in illegal possession of ganja and was selling the same to school children. Hence, the present case.

3. The learned counsel for the petitioner submitted that this is the second anticipatory bail application filed before this Court. The petitioner is an innocent person and has not committed any offence as alleged by the prosecution. She has been implicated in this case solely based on the confession of the 1st accused. He, however, submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) submitted that the 2/4

petitioner has been arrayed as A2 in this case. A1 was arrested. He further submitted that 23 previous cases have been registered against the petitioner, most of which are of a similar nature. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case, and considering the gravity of the offence, and also taking note of the fact that 23 previous cases have been registered against the petitioner, most of which are of a similar nature, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.
