PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the 2nd and 3rd respondents herein not to harass the petitioner in name of enquiry and without due process of law.

ORDER

This Criminal Original Petition has been filed to direct the 2nd and 3rd respondents herein not to harass the petitioner in name of enquiry and without due process of law.

2. By the order dated 06.06.2023, the petitioner was directed to appear before the third respondent herein and co-operate with them to complete the process of enquiry within a period of fifteen days from the date of receipt of a copy of this order in an appropriate manner.

3. The learned Additional Public Prosecutor would submit that in pursuance of the above said order, enquiry was undertaken, but the petitioner did not appear.

4. But the learned counsel for the petitioner would submit that the petitioner appeared once for enquiry before the third respondent. Harassment is made upon the petitioner by the fourth respondent to withdraw the above said complaint.

5. If the harassment is made by the fourth respondent, the petitioner can give a complaint against the fourth respondent. On the basis of the complaint given by the petitioner, no harassment can be made by the third respondent, when the petitioner appear before him. Let the above said enquiry be completed as directed by this Court by the order dated 06.06.2023 in W.P(MD) No.12943 of 2023.

5. With the above said direction, this Criminal Original Petition is allowed.
