PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus to forbear the respondents No.4 and 5 from laying the Thar road or other related works whatsoever in the petitioner's patta land in Survey No.53/2, at Thavasimadai, Dindigul East Taluk, Dindigul District and direct the respondents to restore the said land in its original position by considering the petitioner's representation, dated 30.05.2025 and for other reliefs. ORDER
Heard the learned counsel for the petitioner, learned Special Government Pleader for the respondents 1 to 3 and learned Additional Government Pleader for the respondents 4 and 5.
2. It is the case of the petitioner that on the Western side of the petitioner's property, there are encroachments, which are abutting the land belonging to the 2/5
respondents.
3. It is the further case of the petitioner that instead of removing the encroachments on the road, which is in the Western side of the petitioner's land, the respondents made encroachment on the petitioner's patta land and are laying road.
4. The learned Special Government Pleader for the respondents 1 to 3, on the other hand, submits that if the petitioner makes suitable representation, the same will be considered and disposed of by the District Collector/first respondent.
5. The learned counsel for the petitioner, however, submits that the petitioner has already sent a representation, dated 30.05.2025 to the respondents.
6. Recording the above submissions, this Writ Petition is disposed of by directing the first respondent to consider the representation of the petitioner within a period of two (2) weeks from the date of receipt of a copy of this order. 3/5
