O R D E R

The Writ Petition is filed seeking a direction to the first respondent to cancel the patta stands in the name of second respondent in respect of the property in S.No.257/1 measuring an extent of 0.85.00 hectares situated at Vilpatti Village, Kodaikanal Taluk, Dindigul District by considering the Petitioner's representation, dated 24.4.2023. 2.Heard the learned counsel appearing on either side and perused the materials placed before this Court. 3.According to the Petitioner, the subject property is his ancestral property and patta has been wrongly issued in the name of the second respondent. He submitted a representation on 24.4.2023 and the same has not been considered so far. Hence the Petitioner is before this Court with the present Writ Petition for the relief stated supra.

4.If the Petitioner is aggrieved by the issuance of patta in favour of second respondent, he can file an appeal before the Revenue Divisional Officer. However, in the instant case, the Petitioner submitted an application before the first respondent/the original authority.

5.Mr.A.Baskaran, learned Additional Government Pleader who appears for the first respondent would submit that the subject property was assigned in favour of second respondent's father on 12.09.1984 by the Government and after the death of second respondent, patta has been transferred in the name of second respondent's son Pushparaj. In such circumstances, the request made by the Petitioner cannot be considered. 6.In view of the definite stand taken by the first respondent, without expressing any opinion on the merits of the matter, the first respondent is directed to communicate its decision to the Petitioner within a period two weeks from the date of receipt of a copy of this order.

7.With the above direction, the Writ Petition stands disposed of. No costs.
