ORDER
The petitioner herein seeks a direction to the respondents to survey the property situated in Survey No.3/1B1, with an extent of 5 Acre 2 1⁄2 cents and Survey No.3/1D1 with an extent of 99 cents, Sithuvarpatty Village, Vedasandur Taluk, Dindigul District. 2.Heard the arguments of Mr.J.Mathesh, learned counsel appearing for the petitioner and Mr.A.Baskaran, learned Additional Government Pleader appearing for the respondents 1 and 2. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
3.According to the petitioner, he purchased a large extent of land with an extent of 7 Acres and 52 1⁄2 cents in the above mentioned survey numbers under a
registered document dated 07.05.2019. Thereafter, the petitioner sold 1 1⁄2 acres in favour of one Murugan and Periyanayaki. Now, the petitioner has been in possession and enjoyment of 5 acres and 2 1⁄2 cents in the above mentioned survey numbers. In order to earmark the property sold to the alienee and to avoid any boundary dispute, the petitioner submitted an application for survey of the property on 17.04.2025. The petitioner has also paid necessary charges for survey. However, the application of the petitioner has not been considered by the respondents. Hence, he has come before this Court.
4.The learned Additional Government Pleader appearing for the respondents would submit that the application of the petitioner will be considered on its own merits within the time stipulated by this Court. 5.In view of the same, without expressing any opinion on the merits of the claim made by the petitioner, the respondents are directed to consider the application submitted by the petitioner dated 17.04.2025 and pass final orders on its own merits, within a period of eight weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner and other interested parties. Accordingly, this Writ Petition is disposed of. No costs.
