ORDER

The petitioner herein seeks a direction to the first respondent to dispose of her appeal, dated 11.02.2024, pending on the file of the first respondent with regard to grant of patta in respect of the property situated at S.No.149/5 to an extent of 872 1⁄2 sq.ft., 24th Ward, Palayapalayam, Road, Karunkattankulam Village, Chinnamanur Municipality, Uthamapalayam Taluk, Theni District.

2. Heard the arguments of Mr.K.Guhan, learned counsel appearing for the petitioner and Mr.A.Baskaran, learned Additional Government Pleader, who takes notice on behalf of the respondents.

3. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

4. According to the petitioner, she purchased the aforementioned property under registered sale deed dated 12.09.2023 and preferred an appeal before the first respondent seeking issuance of patta on 11.02.2024. The first respondent sought for a report from the second respondent vide his proceedings in XK.vz;: 2391/2024/m3, dated 16.05.2024. Thereafter, there was no progress in the appeal filed by the petitioner seeking issuance of patta. Hence, the petitioner has come before this Court.

5. Mr.A.Baskaran, learned Additional Government Pleader, who takes notice for the respondents, would submit that the request of the petitioner will be considered on its own merits, within a time stipulated by this Court.

6. In view of the same, without expressing any opinion on the merits of the claim made by the petitioner, the second respondent is

directed to submit a report to the first respondent within a period of four weeks from the date of receipt of a copy of this order and the first respondent shall consider the appeal filed by the petitioner based on the report submitted by the second respondent and pass final orders on its own merits, within further period of eight (8) weeks.
