O R D E R

This writ petition has been filed challenging the impugned order passed by the 2nd respondent in Na.Ka.No.106/SBC PS/2023, dated 04.06.2023 and seeking direction to the 2nd respondent to give police protection to conduct Shree Sambhasivan and Parivaara Deivangal Temple Kumbhabishegam Thiruvizha.

2.Mr.B.Nambiselvan, learned Additional Public Prosecutor, takes notice for the respondents.

3.The case of the petitioner is that earlier this petitioner has filed a petition seeking direction to the respondent police to grant permission and police protection, for conducting the Kumbhabishekam festival for the above said temple in W.P.(MD).No.10859 of 2023, on the basis of the petitioner's representation, dated 18.04.2023. Wherein, this Court directed the respondent police to dispose the petitioner's representation immediately, by hearing the petitioner as well as the rival parties and 2/5

liberty was also granted to the petitioner to workout his remedy through appropriate proceedings, depending upon the outcome of the above said enquiry, if so aggrieved. When this proceedings are pending, the third respondent had issued pamplets for conducting Kuthirai Eduppu festival. For taking action against the third respondent, the petitioner has given a representation on 13.05.2023 before the second respondent and the same was rejected. Therefore, challenging the same, the present writ petition has been filed. Further, he seeks permission to conduct Kumbhabishekam festival to the above said temple.

4.The learned Additional Public Prosecutor would submit that in pursuance of the order that has been passed by this Court in W.P. (MD).No.10859 of 2023, no peace committee meeting was conducted so far.

5.Let the peace committee meeting be conducted by the Tahsildar, Peravurani, who is the competent authority, on 30.06.2023. Depending upon the resolution taken in the peace committee meeting, the parties can take further action.
