O R D E R

This Criminal Original Petition has been filed to direct the learned Judicial Magistrate Court, Rajapalayam to expedite the trial in C.C.No.20 of 2019 and to fix the time frame to be completed within the stipulated time as framed by this Court. 2.The learned counsel for the petitioner would state that the petitioner and his wife purchased the property from the first accused and the same was already sold by the father of the first accused who is the real owner of the property in dispute and the other accused are concerned, they were fabricated the documents and conspired to cheat the petitioner with the prime accused. Hence, the respondent police registered the case in Crime No.604 of 2017 for the offence under Sections 120(b), 294(b), 354, 420, 467, 468, 471 and 506(ii) I.P.

C and after completing investigation, the respondent police filed the final report before the learned Judicial Magistrate, Rajapalayam and the same was taken on file in C.C.No.20 of 2019. He further submitted that though the occurence happend in the year 2017, charge sheet was filed only in the year 2019 and till now, no progress to proceed the case. Hence, the present petition is filed for speedy disposal of the trial.

3.The learned Additional Pulic Prosecutor appearing for the respondent would submit that there are totally 21 witnesses to be https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD).No.12739 of 2020 examined and hence, he seeks six months time to complete the trial.

4.Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor appearing for the respondent.

5.Considering the submissions made on either side, the learned Judicial Magistrate, Rajapalayam, is directed to conclude the entire trial proceedings in C.C.No.20 of 2019 within a period of six months from the date of receipt of a copy of this order. 6.With the above direction, this Criminal Original Petition is disposed of.
