PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 and 2 to take departmental action against the third respondent by considering the petitioner's representation dated 15.05.2019, within the time period stipulated by this Court. ORDER
This Writ Petition has been filed to direct the respondents 1 and 2 to take departmental disciplinary action against the third respondent.
2.The learned counsel appearing for the petitioner would submit that with reference to the prayer sought for in this writ petition, the petitioner sent a representation to the respondents https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD) No.15824 of 2019 1 and 2 on 15.05.2019. But, so far, no action has been taken. Hence, the petitioner is before this Court for the relief stated supra.
3.In reply, the learned Standing Counsel appearing for the respondents 1 and 2 would submit that the petitioner's representation dated 15.05.2019, would be considered on merits and in accordance with law subject to if any case is made out to take departmental disciplinary action against the third respondent, within a time frame to be fixed by this Court. 4.Having regard to the limited scope of the prayer made by the petitioner and considering the submissions made on either side, this Court, without expressing any opinion on the merits of the case, directs the respondents 1 and 2 to consider the petitioner's representation dated 15.05.2019, on merits and in accordance with law as expeditiously as possible, after affording due opportunity of hearing to the parties concerned.
5.With the above direction, this Writ Petition is disposed of. No costs.
