Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the second respondent i.e., the Revenue Divisional Officer, Melur @ Narasingampatti to pass appropriate orders for correcting the extent of house site owned by the petitioner i.e., 139 sq.m in the Town Survey Plot No.16A(T.S.No.10/2A4) of Melur Town, based on the report sent by the Tahsildar, Melur in his letter No.S2/5347/2021 dated 18.04.2022 and subsequent enquiries conducted by the Revenue Divisional Officer, Melur @ Narasingampatti.

This writ petition has been filed to direct the second respondent i.e., the Revenue Divisional Officer, Melur @ Narasingampatti to pass appropriate orders for correcting the extent of house site owned by the petitioner i.e., 139 sq.m in the Town Survey Plot No.16A(T.S.No.10/2A4) of Melur Town, based on the report sent by the Tahsildar, Melur in his letter No.S2/5347/2021 dated 18.04.2022 and subsequent enquiries conducted by the Revenue Divisional Officer, Melur @ Narasingampatti.

2. Heard the learned counsel appearing on either side and perused the materials placed before this Court.

3. The learned Special Government Pleader appearing for the respondents would submit that already the third respondent has passed an order and aggrieved by the order, the petitioner also preferred an appeal before the second respondent.

4. Therefore, the second respondent is directed to dispose the appeal filed by the petitioner and pass orders on merits and in accordance with law within a period of two weeks from the date of receipt of a copy of this order after giving an opportunity of hearing to the petitioner and counter party, if any.

5. With the above direction, the writ petition stands disposed of. No costs.
