ORDER
The petitioner, with an allegation that the second respondent police is harassing him under the guise of an enquiry has approached, this Court.
2.The learned Additional Public Prosecutor appearing for the official respondents submits that based on the complaint given by the third respondent before the first respondent, an enquiry has been initiated and the same is pending from 28.05.2024.
3.The content of the complaint is that the petitioner's brother has received a sum of Rs.90,00,000/- from the third respondent for executing document. However, without executing document in favour of the complainant, he has executed the said document in favour of the petitioner. This complaint appears to be civil in nature. The Superintendent of Police referred the matter mechanically for enquiry and the enquiry is also kept pending on the file of the second respondent, for more than a month. The Police Standing Orders prohibits the Police 2/4
from interfering in the civil dispute. The Director General of Police is also issuing circulars periodically. It is not known for what purpose these circulars have been issued. These circulars are also not complied with by the official respondents as well as the Higher Officials. Since the dispute between the parties is civil in nature and that too pending for more than a month, the official respondents are directed not to harass the petitioner.
