PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents 1 to 4 to refrain from granting patta to any person in respect of the Government Poramboke pathway comprised in Survey No.606/1, situated at Kamuthi Town, Kamuthi Taluk, Ramanathapuram District by considering the petitioner's representation dated 27.03.2026.

This petition has been filed seeking to direct the respondents 1 to 4 to refrain from granting patta to any person in respect of the Government Poramboke pathway comprised in Survey No.606/1, situated at Kamuthi Town, Kamuthi Taluk, Ramanathapuram District by considering the petitioner's representation dated 27.03.2026.

2. The learned counsel for the petitioner submitted that Survey No. 606/1 is classified as a Government poramboke pathway and, therefore, no private individual is entitled to obtain a patta in respect of the said land.

The learned Government Advocate (Civil Side) submitted that the Head Deputy Tahsildar, Kamuthi, had issued a communication dated 12.02.2026 in O.Mu.(B8) No.60/2026 stating that the land in question is classified as a Government Poramboke pathway in the village records and, therefore, private individuals are not entitled to the grant of patta. Subsequently, another communication dated 11.03.2026 was issued indicating that a survey would be conducted in Street Survey No.27, hence the petitioner is aggrieved by the said communication dated 11.03.2026 on the ground that, when the 3rd respondent has already acknowledged that the land is classified as Government Poramboke pathway land, there is no justification for conducting a survey with a view to considering the claim of private individuals for patta.
4. On a perusal of the communication dated 11.03.2026, it is evident that the respondents have merely proposed to conduct a survey No.27. In the 3/6
event that the subject land is found to be a pathway, the respondents 1 to 4 would not be in a position to issue patta solely on the basis of such survey. Therefore, the petitioner would not be prejudiced if the survey is conducted.

Considering the facts and circumstances of the case, this Court directs the respondents 1 to 4 to conduct an enquiry after issuing notice to the petitioner as well as the 5th respondent and thereafter, pass appropriate orders within a period of three months from the date of receipt of a copy of this order.
