ORDER

The petitioner, seeking Police protection to cut and remove Juliflora trees from his patta land, has submitted a representation 09.04.2025 before the respondent Police and filed this petition seeking a direction to the respondent Police to provide Police protection.

2.The petitioners have made certain allegations as against the sixth respondent that he is creating problem and also preventing the petitioners from removing the Juliflora trees. Therefore, this Court by its earlier order dated 06.06.2025, ordered notice to the sixth respondent. Mr.G.Prabhu Rajadurai, learned counsel entered appearance and requested time to file a counter affidavit. Adequate time has been granted to file a counter affidavit, however, the same has not been filed.

3.The learned counsel appearing for the petitioners submits that the sixth respondent has filed a Public Interest Litigation before the Division Bench of this Court questioning the manner in which, the patta has been granted to the petitioners and there is no interim order granted.

4.The learned Special Government Pleader appearing for the respondents 1 to 3 submits that the patta for the subject lands stands in the name of the petitioners. A report has also been filed to that effect.

5.Considering the fact that the patta stands in the name of the petitioners and it has not been cancelled and also considering the report filed by the Tashildar, Ramanathapuram, this Court directs the fifth respondent to provide Police protection to cut and remove the Juliflora trees in the subject lands. The sixth respondent has to workout his remedy before the appropriate forum. Accordingly, this 4/6

writ petition is allowed. No costs. Consequently, connected miscellaneous petition is closed.
