PRAYER :-Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the Respondents to pay the benefit of the old pension scheme and the monthly pension to the petitioner with effect from the date of appointment with all monetary and service benefits. ORDER

By consent of both sides, the writ petition itself is taken up for final disposal at the stage of admission itself.

2. This writ petition has been filed for a mandamus directing the respondents to pay the benefit of the old pension scheme and the monthly pension to the petitioner with effect from the date of appointment with all monetary and service benefits.

3. The petitioner was appointed as a Watchman in the 5th respondent school on 16.03.2002. However, his appointment was not approved by the educational authorities and hence, the 5th respondent 2/5

school filed a writ petition before this Court in WP(MD) No.11554 of 2008 and this Court, vide order dated 12.03.2009, allowed the writ petition by issuing a direction to the authorities to approve the appointment of the petitioner with effect from 16.03.2002. Subsequently, when the order was challenged before this Court in WA(MD) No.165 of 2010, vide judgment dated 20.07.2012, the order of the writ Court was modified and the authorities were directed to approve the appointment of the petitioner with effect from 07.02.2006. Accordingly, the petitioner's appointment was approved with effect from 07.02.2006. However, the petitioner made a representation dated 26.05.2025 to the respondents to take into account his date of appointment as 16.03.2002 instead of 07.02.2006 for the purpose of pension. Since the said representation was not considered, the petitioner is before this Court.

4. Heard the learned counsel for the petitioner.

5. The learned Additional Government Pleader would submit that the representation of the petitioner would be considered and orders 3/5

would be passed.

6. Considering the limited scope of the matter, without adverting to the merits or the contentions made, the writ petition is disposed of with a direction to the respondents 1 to 4 to consider the representation of the petitioner dated 26.05.2025 on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order.
