For Respondent : Mr.R.M. Anbunithi Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.157 of 2022 on the file of the respondent Police.

ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioners and the learned Additional Public Prosecutor (Crl. Side) appearing for the respondent.

2. The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under sections 420 IPC 25(1A) of Arms Act & 7(3) of Lotteries Regulation Act in Crime No. 157 of 2022 on the file of the respondent police, seek/s anticipatory bail.

3. The case of the prosecution is that on 13.07.2022 while the respondent police was in routine check up the petitioners said to have found in possession of Lottery Tickets in their car bearing https://www.mhc.tn.gov.in/judis

Regn. No.TN 72 BP 9889, which is banned by the Government of Tamil Nadu. On enquiry, one velmurugan who drove the vehicle implicated as A1.

4. The learned counsel appearing for the petitioner submitted that the petitioners are innocent and their names have been falsely implicated in this case and the investigation of the case is pending. He would further submit that except the statement of the first accused no other materials against these petitioners.

5. The learned Government Advocate (Crl. Side) appearing for the respondent police would submit that already the 1st petitioner is having 4 previous cases and the 2nd petitioner is having 5 previous cases in similar nature under Section 420 IPC including the Lotteries Regulation Act

6. Considering the facts and circumstances and also considering the fact the petitioners are having previous cases of similar nature and that they have involved in the illegal activities, the custodial interrogation of the petitioners is necessary. Hence, this Court is not inclined to grant anticipatory bail to the petitioners.
