Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.M.KURUS CHELIN RANI, Advocate for the petitioner and of Mr.A.ALBERT JAMES, Government Advocate (Crl. side) on behalf of the Respondent, the court made the following order:- This petition has been filed to relax the condition imposed against the petitioner in Crl.M.P.MD)No.8488 of 2022 in Crl.A(MD) No.171 of 2022, dated 25.07.2022.
2. It is seen from the records that on the application filed by the petitioner, the condition was modified and the petitioner was directed to appear before learned Special Judge cum Chief Judicial https://www.mhc.tn.gov.in/judis 1/2
CRL MP(MD) No.8828 of 2023 Magistrate, Kanyakumari District at Nagercoil on the first working day of alternative months at 10.30 am until further orders.
3. The only contention raised by the petitioner is that the petitioner is aged 84 years. Considering the age of the petitioner, the condition was modified earlier.
4. The petitioner has not canvassed any other reason or ground to modify the condition further. Hence, this Court is not inclined to modify the condition. Accordingly, the Criminal Miscellaneous Petition is dismissed.
